Quadricycle Rental Agreement, Waiver of Liability, and Assumption of Risk

Please read this document carefully before renting or operating any quadricycle.

By clicking the checkbox labeled "I have read and agree to the Terms and Conditions, Waiver of Liability, and Assumption of Risk" (or similar confirmation during the booking/rental process), submitting payment (including deposit), or taking possession of the quadricycle (also referred to as side-by-side, SxS, UTV, or vehicle), you (the "Renter," "you," or "your") acknowledge that you have read, fully understood, and agree to be bound by this Rental Agreement, Waiver of Liability, and Assumption of Risk.

Credit Card / Saved Payment Method Authorization By clicking the acceptance checkbox, providing your credit card information, using a saved payment method on a device where your passwords are stored, or authorizing any payment (including deposit or full rental fee), you expressly authorize Discovery SxS and Tours to charge your provided credit card or saved payment method for:

• All rental fees, deposits, and any additional charges outlined in this agreement.
• Any non-maintenance-related damages, repairs, cleaning fees, lost items, or other costs incurred during or resulting from your rental period, as determined by the Company's inspection.
• Any other amounts you become liable for under this agreement (e.g., traffic violations, fines, or penalties if applicable).

You acknowledge and agree that authorizing payment in this manner (including via saved credentials on your device) constitutes your binding acceptance of all terms, risks, and liabilities in this agreement. You are liable for any charges processed in accordance with these terms and waive any right to dispute legitimate charges related to this rental.

1. Acceptance of Terms

By clicking the checkbox to confirm acceptance, paying the deposit, or taking possession of the vehicle, you accept these terms on behalf of yourself and all persons who will operate or ride in the vehicle. Operation or use of the vehicle constitutes full acceptance of all risks, rules, and obligations outlined herein.

2. Assumption of Risk and Full Release of Liability

Operation of a quadricycle involves significant inherent risks, including but not limited to: interaction with real traffic, variable road and off-road conditions, weather changes, vehicle rollover, collisions, loss of control, personal injury, pain and suffering, property damage, or death. These risks may arise from your own actions or inactions, the actions of other drivers or road users, road conditions, mechanical issues, or unforeseen events.

You voluntarily assume all such risks and full responsibility for any injury, loss, damage, pain and suffering, or death that may occur during or related to the rental and use of the quadricycle.

In consideration of being permitted to rent and operate the vehicle, you hereby release, waive, discharge, and covenant not to sue Discovery SxS and Tours, its owners, employees, agents, contractors, or affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, pain and suffering, or death that may be sustained by you, your passengers, or your property—whether caused by the negligence of the Released Parties or otherwise.

This release extends to all claims, known or unknown, and includes attorney's fees and costs.

You are solely responsible for your actions and decisions while operating the vehicle.

Although the Company takes extreme precautions to promote safety, not all scenarios can be foreseen, and operation of the vehicle—even in intended practices—can be dangerous or deadly.

3. Responsibility for Damages

• You are responsible for all non-maintenance-related damages to the quadricycle during the rental period, including but not limited to body damage, tires, wheels, windshield, interior, accessories, or any damage caused by misuse, accident, negligence, or off-road incidents.
• Maintenance-related issues (e.g., normal wear, mechanical failures not caused by renter misuse) are the responsibility of the Company.
• Upon return, the vehicle will be inspected. Any non-maintenance-related damage will be deducted from your deposit or charged to your authorized credit card/saved payment method if costs exceed the deposit or if no deposit applies.

4. Traffic Violations and Independent Use

• If you are renting the quadricycle without participating in a guided tour, you are solely and fully responsible for all traffic violations, citations, accidents, or any actions you perform while operating the vehicle.
• You must obey all applicable traffic laws, highway rules, and safe operating practices at all times.
• The Company is not responsible for any fines, towing, impoundment, legal fees, or consequences resulting from your operation of the vehicle.

5. Deposit and Return Policy

• A security deposit is required at the time of rental (pre-authorized on your credit card or saved payment method).
• The deposit will be returned (or authorization released) in full within 5 business days following the satisfactory return of the vehicle, provided:
  • The vehicle is returned on time and in the same condition (normal wear excepted).
  • A complete inspection confirms no non-maintenance-related damage.
  • All rental terms have been complied with.
• If damages or other charges apply, the deposit (or portion thereof) will be retained, and/or your credit card/saved payment method will be charged for the balance. You will be notified of any such charges.

6. General Provisions

• You confirm that you are physically and mentally capable of safely operating the quadricycle and hold a valid driver's license if required by law.
• You must be of legal age (or have parental/guardian consent if under 18).
• This agreement shall be governed by the laws of the jurisdiction in which the Company operates.
• If any provision is held invalid, the remainder shall remain in effect.
